Consumers who purchased Dole fruit cups may be eligible for money as part of $4.3M settlement

STATEN ISLAND, N.Y. — If you have purchased a Dole fruit cup in the last six years, you may be eligible for money from a $4.3 million class action settlement.

The class action settlement resolves a lawsuit against Dole that claims the company advertised, marketed and sold the cups representing the fruit was contained “in 100% fruit juice” or “in 100% juice,” when the items contained trace amounts of ascorbic acid and/or citric acid or other ingredients (added ingredients).

Dole has denied any wrongdoing and contends the fruit cups have always been appropriately marketed and labeled. Dole agreed to include explanatory language that is in the process of being added to certain fruit bowls labels, including ““with other natural flavors and ascorbic and citric acids,” “with added vitamin C and natural flavors” or similar language.

You may be eligible for money from this settlement if you purchased Dole brand and Dole fruit bowl products, including Cherry Mixed Fruit; Diced Apples; Diced Pears; Diced/Chunk Mango; Papaya Mango; Peach Mango; Mandarin Oranges; Mixed Fruit; Pineapple Tidbits/Slices/Chunks/Crushed; Mixed Fruit; Pineapple Paradise; Red Grapefruit Sunrise; Melon Medley; Tropical Fruit; or Diced/Sliced Peaches labeled “in 100% juice” or “in 100% fruit juice.” You must have purchased the fruit cups for personal use between Jan. 12, 2017, and June 27, 2023 — in-store or online in the United States.

If you have proof of purchase, you may receive a cash refund of up to $18 per household. If you don’t have proof of purchase, you can receive a cash refund of up to $9 per household.

The deadline to file a claim and receive a cash payout is Sept. 25.
